Appanoose County man has lengthy criminal history

CENTERVILLE — An Appanoose County man involved in at least 27 assorted criminal court proceedings including felony, simple, aggravated and serious misdemeanors dating back to 2005 was back in front of a judge in February.

Appanoose County Attorney Richard Scott on July 31, 2012 filed trial information charging Dustin Kenneth Saldana with one count of manufacture, deliver or possess with intent to manufacture or deliver marijuana, not more than 50 kilograms, a class D felony.

On Feb. 1 Judge Kirk A. Daily sentenced Saldana, 25, of Centerville, to 365 days in jail, 363 days suspended, credit for any time served, two years probation no supervision and fine on the charge of possession of a controlled substance, a serious misdemeanor.

Scott filed amended trial information on Feb. 1 to include count II, possession of marijuana, second offense, a serious misdemeanor. Saldana on Feb. 1 filed a wavier of rights and guilty plea for possession of marijuana.

The court on Feb. 1 dismissed one count of controlled substance violation, a class D felony with an offense date of April 3, 2012.

The Centerville Police Department filed a criminal complaint on July 12, 2012 charging Saldana with delivery of marijuana. The complaint states Saldana on April 3, 2012 at the intersection of 10th Street and Jackson Street in Centerville at approximately 6:45 p.m. delivered an quantity of marijuana to a confidential informant working under the direction of law enforcement.

Saldana owes Appanoose County $792.25 for this criminal case.

Saldana has been involved in four felony, seven serious, one aggravated and 15 simple misdemeanor criminal court proceedings dating back to 2005 in Appanoose County. Some of those cases were dismissed, but all told, Saldana still owes Appanoose County more than $7,000 dating back to 2005.

Saldana is no stranger to the criminal court system and felony charges in Appanoose County.

On Oct. 26, 2012 Judge Kirk A. Daily accepted Saldana's negotiated, voluntary guilty plea on the charge of third degree attempted burglary, an aggravated misdemeanor, and sentenced him to two years in state prison, suspended, two years probation with the Department of Corrections, fine and credit for any time served.

The charge had a offense date of Jan. 18, 2012.

The court dismissed Oct. 26, 2012 one count of second degree theft, a class D felony and one count of third degree attempted burglary, both with an offense date of Jan. 18, 2012.

Saldana owes Appanoose County $2,202.72 for this criminal case.

On Dec. 13, 2011, the court dismissed one count of willful injury, causing serious injury, a class C felony with an offense date of April 26, 2011.

Saldana owes Appanoose County $150 for this criminal case.

On May 11, 2010 the court dismissed one count of second degree burglary, a class C felony and one count of fourth degree criminal mischief, a serious misdemeanor, both with an offense date of March 10, 2010.

Saldana is no stranger in the Appanoose County court system when it comes to serious misdemeanors. Saldana has been involved in seven of those in Appanoose County.

The court accepted Saldana's negotiated, voluntary guilty plea and on March 30, 2012 sentenced him to suspended jail on the charge of fourth degree criminal mischief. The criminal charge had an offense date of Dec. 22, 2012.

Saldana owes Appanoose County $744 for this criminal case.

The criminal case against Saldana, where he was charged with possession of a controlled substance, offense date Oct. 15, 2011, was closed as of Dec. 15, 2011.

The court accepted Saldana's negotiated, voluntary guilty plea and on Dec. 9, 2011 sentenced him to a fine, two years probation to the court, credit for any time served, 180 days in in jail with 178 suspended on the charge of possession of a controlled substance. The criminal charge had an offense date of Oct. 15, 2011.

Dismissed Dec. 9. 2011 was one count of assault causing bodily injury, a serious misdemeanor with an offense date of Oct. 13, 2011.

Saldana owes Appanoose County $860.25 for this criminal case.

On Dec. 9, 2011, Appanoose County Judge Kirk A. Daily sentenced Saldana for the charge of possession of a controlled substance, a serious misdemeanor to a fine, two years probation to the court, credit for any time served, 180 days in jail, suspended 178. Saldana entered a negotiated, voluntary guilty plea to charge with an offense date of April 3, 2011.

Saldana owes Appanoose County $660.25 for this criminal case.

On May 11, 2010, one count of possession of a controlled substance, serious misdemeanor, was dismissed by the court. The charge carried an offense date of March 18, 2010.

On Jan. 25, 2008, one count of criminal mischief, fourth degree, a serious misdemeanor, was dismissed by the court. The charge carried an offense date of Oct. 16, 2007.

Saldana owes Appanoose County $420 for this criminal case.

On Jan. 25, 2008 Judge Kirk A. Daily sentenced Saldana on the criminal charge of assault causing bodily injury, a serious misdemeanor, to a fine, 90 days in jail, suspended 78 days, two years probation unsupervised and credit for 12 days served.

Saldana entered a negotiated, voluntary guilty plea to the charge.

The criminal charge's offense date was Sept. 26, 2007.

Saldana owes Appanoose County $856.56 for this criminal charge.

The one aggravated misdemeanor charge was dismissed in December of 2010.

Of the 15 simple misdemeanor charges, five were dismissed, nine he entered a guilty plea and one has not been adjudicated. Saldana owes more than $500 for five of these charges.
