On March 29 Judge Kirk A. Daily sentenced Amy Sue Cunningham, 21, of Moulton, to 365 days in county jail, all but two days suspended, fine and two years probation for one count of drunken driving and two years in prison, suspended, fine, two years probation and credit for any time served for one count of child endangerment. The sentences were ordered to run consecutive with each other.
Cunningham was ordered to complete a drinking drivers and substance abuse evaluation.
Two counts of neglect of a dependent person, class C felonies, were dismissed April 3 and one count of eluding, a serious misdemeanor, was dismissed on March 29.
According to the criminal complaint and affidavit filed on Aug. 21, 2012 by the Centerville Police Department, Cunningham was involved in a high speed chase with a van being driven by Jerry Horn. Inside the van were Cunningham’s two minor children.
At one point the chase involved three police patrol vehicles in the 1000 block of East State Street.
Once Cunningham and Horn were stopped, both refused verbal commands to exit their vehicles and both had to be physically removed while resisting.
The offense date for all five charges was Aug. 20, 2012.
Cunningham owes $3,150.13.
Cunningham is also facing one count of interference with official acts, bodily injury, an aggravated misdemeanor.
