City Council modifies municipal code

CENTERVILLE — The Centerville City Council Monday night passed a resolution amending one chapter, creating two chapters and deleting redundant provisions of the city's municipal code.

What does it mean for Centerville residents and city employees?

The two chapters added to the code spell out the powers, duties, compensation, appointment and term for the animal control officer and building official. In both cases, the council appoints the building official and animal control officer to a term expiring by council removal, retirement of resignation.

The building official's duties include the enforcement of building and construction, minimum housing standards, zoning and other items proscribed by code, city administrator or council.

The animal control officer's duties include animal control and other duties as proscribed by the city administrator or council.

Both the building official and animal control officer report to the city administrator and council determines compensation.

The use of "building inspector" in the code changes to "building official."

Nine "appointment" sections were replaced by "appointment and term" for the city clerk, treasurer, city engineer, commission of municipal services, superintendent, street commissioner, chief of police, fire chief and community development coordinator. In each section the council is responsible to appoint an individual to a term commencing on the day of appointment and expiring on the person's removal by the council, retirement or resignation.

One chapter was modified to delete the definition of "department head" and replaced so "department head" now refers to the city clerk, commissioner of municipal services, superintendent, street commissioner, building official, animal control officer, chief of police and fire chief.

In a related matter, a section was added to state the termination or demotion of an employee from department head to non-department head requires a 4/5's affirmative vote by the council.

A schedule of fines was approved.

Under "General Fine," which applies to all criminal misdemeanor offenses and civil municipal infractions, the first offense is $100, second offense is $200 and third or subsequent offense is $300.

Under "Scheduled Penalties," "Offenses and Nuisances," first offense is $500, second offense is $750 and third or subsequent offense is $900. However, if the violation is a criminal misdemeanor, the maximum fine would be $650 for the second and third or subsequent offenses.
