A 23-year-old Centerville man has a hearing in the Appanoose County Courthouse on May 19 to determine if the Appanoose County attorney can reinstate prosecution for a class C felony sexual abuse case that dates back to May of 2008.
Acting Appanoose County attorney Alan Monroe Wilson filed the application to reinstate on May 5.
The case involves Kevin Wade Powers, who was charged by trial information filed on March 23, 2009 by then Appanoose County Attorney Richard Scott on two counts of third degree sexual abuse, victim age 12-13, class C felonies with offense dates of May 1 and May 2, 2008.
Powers’ attorney Jonathan Willier on April 13, 2009 filed a written plea of not guilty to the charges.
After several continuances, plea proceedings was set for Sept. 18, 2009 in Associate Court.
An arrest warrant for Powers was filed on Sept. 14, 2009 for an alleged pretrial violation. A filing on Sept. 23, 2009 shows the Appanoose County sheriff’s office served the warrant against Powers.
Filed on Sept. 18, 2009 Scott amends his trial information and plea proceedings and sentencing was set for Oct. 2, 2009.
Filed on Oct. 2, 2009 a new sentencing date was set for Nov. 20, 2009.
A motion was filed by Willier on Nov. 16, 2009 to suspend sentencing.
Judge Kirk A. Daily on Nov. 20, 2009 filed an order to suspend sentencing.
