Judge sends Wayne County man to prison for sex- and drug-related convictions

CENTERVILLE — A Wayne County man police originally charged with 30 counts of sex abuse and lascivious acts with a minor female, one controlled substance count and one burglary count has been sentenced to serve 20 years in state prison.

Patrick David Russell, 40, of Allerton, entered voluntary, negotiated guilty pleas to one count of third degree sexual abuse, victim under 20 and one count controlled substance violation, both class C felonies.

On April 2, 2012 Judge Sherman Phipps sentenced Russell to 10 years in state prison, fine and participation in the sex offender program for the sexual abuse plea and 10 years in state prison and a fine for the controlled substance violation plea. The sentences were ordered to run consecutive to one another.

The sentence stipulates Russell must complete the sex offender program or serve the entire sentence.

Russell was arrested by law enforcement Aug. 22, 2011. A no-contact order was issued the same day.

Wayne County Attorney Alan M. Wilson on Sept. 29, 2011 charged Russell with 15 counts of third degree sexual abuse, victim under 20 years of age. Wilson alleged Russell between Jan. 1, 2011 and July 26, 2011 in Wayne County engaged in a sex act with a 15-year-old female.

The original controlled substance violation count against Russell was a class B felony with an offense date of July 31, 2011.

Judge Phipps dismissed the remaining 14 counts of third degree sexual abuse against Russell on April 2.

Russell was facing 15 counts of third degree sexual abuse and 15 counts of lascivious acts with a child, touch or fondle, all class C felonies. The criminal complaint filed Aug. 16, 2011 alleges Russell from January to July 2011 performed various sex acts with a 15-year-old female.

A third criminal case — one count of third degree burglary, a class D felony with an offense date of July 31, 2011 — was closed on Feb. 2, 2012.

Russell was given credit for 222 days served and he was ordered to lifetime supervision by the Department of Corrections.

Russell owes the state $3,462.40.
