Driver in two-person vehicle fatality sentenced in Marion Co.

CENTERVILLE — After nearly 30 months the driver involved in a two-vehicle accident that killed two Appanoose County men was found guilty by the court and was sentenced in Marion County to three suspended state prison sentences.

Jeremy Glenn Smith, 32, of Centerville, was driving a Geo Prizm on Friday, June 25, 2010 in Marion County when he was involved in a head-on collision. His two passengers, Curtis James Temple II, of Centerville and David Keith Burton, of Exline did not survive the injuries they received as a result of the accident.

Judge John D. Lloyd sentenced Smith Nov. 30 in Marion County to 10 years in state prison, suspended to five years probation with the Department of Corrections for each reduced charge of two counts of homicide by vehicle-reckless driving or attempt to elude. The two sentences were ordered to run consecutive with one another, or for 10 years probation.

The original charges filed against Smith by the Marion County attorney was two counts of vehicular homicide/ OWI, class B felonies.

The third count filed by the Marion County attorney was one count of serious injury by vehicle, a class D felony. Judge Lloyd sentenced Smith to five years in state prison, suspended to five years probation to the Department of Corrections for this charge to run consecutive with the other two.

All told, Smith received 25 years suspended prison and 15 years probation. If Smith fails to complete probation he could be ordered to serve the entire prison sentence.

Judge Lloyd imposed a $5,000 fine for each count and ordered Smith to pay $150,000 restitution to each estate or heirs of the two deceased men, Temple II and Burton. Iowa Courts online shows Smith owes $323,803.77 for costs associated with this case.

The driver of the second vehicle, Amanda Ann Bridgman, of Oskaloosa, at the time was listed as serious but stable and was flown to Methodist Hospital in Des Moines.

Smith at the time was flown from the scene to Mercy Medical Center in Des Moines and was listed in fair condition.

The accident occurred at 5:45 a.m. in the 1700 block of Highway T17 near the South Central Iowa Solid Waste Agency in Marion County.
