Derrick Eugene Duffey, 30, of Centerville, was sentenced to state prison following his conviction in April of this year for a third or subsequent drug offense.
Judge Rose Anne Mefford April 26 sentenced Duffey on the charge of possession of a controlled substance, third or subsequent offense, a class D felony, to five years in state prison, fine, suspended and given credit for any time served. In this case it was methamphetamine.
Duffey was originally facing three felony counts in this case; two were dismissed. One count of second degree burglary, a class C felony, was dismissed April 30 and one count of possession of a controlled substance, third or subsequent offense, a class D felony, was dismissed April 26. The offense date for all three counts was Dec. 27, 2012.
The criminal complaint filed Dec. 27, 2012 by Centerville Police states Duffey entered an occupied residence in the 600 block of West Maple Street at approximately 2:59 a.m. Dec. 27, 2012 with the intent to commit an assault. A 40-year-old woman inside at the time said she did not know who the defendant was and thought he was there to assault her.
When law enforcement arrived, Duffey was found passed out inside the enclosed front porch. Duffey was taken into custody after a brief struggle and transported to the Law Center.
Duffey was patted down at the Law Center and found in his possession was residue on a $20 bill that tested positive for methamphetamine, a small tin container with one pill inside later identified as hydromorphone and a plastic bag containing 1.1 grams of meth.
Mercy Ambulance was summoned to assess Duffey who appeared to be reacting from an overdose of meth. Duffey was taken to Mercy Medical Center and later airlifted to Mercy Hospital in Des Moines for additional treatment.
The five year prison sentence in that case was ordered to run concurrently with the five year prison sentence, suspended to five years probation, Duffey was given on April 1, 2011 for the criminal count of possession of lithium, a class D felony. Judge Mefford April 26 revoked probation and imposed the original prison sentence.
Duffey’s other drug conviction was in April of 2002 for possession of marijuana.
Duffey has a criminal conviction for assault causing bodily injury, a serious misdemeanor, were he was sentenced Nov. 30, 2012 to 365 days in jail suspended to two years probation. The offense date was July 1, 2012.
Duffey owes $4,823.14.
