An Appanoose County man was sentenced to probation for his involvement to deliver marijuana in March of this year.

Derek Riley Miller, 20, of Moravia, entered a voluntary negotiated guilty plea on Oct. 30 to possession of less than 50 kilograms of marijuana with the intent to deliver, a class D felony. Judge Kirk A. Daily sentenced Miller to 5 years in prison, suspended to 5 years probation with the Eighth Judicial District Department of Correctional Services and a $750 fine, a 32 percent surcharge, a $125 law enforcement surcharge and a $10 DARE surcharge.

Judge Daily dismissed two other charges against Miller.

Miller was arraigned on the charges of possession of a controlled substance with intent to deliver more than 50 kilograms of marijuana, a class C felony and possession of methamphetamine enhanced, an aggravated misdemeanor filed by Appanoose County Attorney Richard Scott on April 27.

Court documents show the charges stemmed from a March 14 incident where Centerville police confronted Miller at a local convenience store and a subsequent search found he was in possession of eight baggies containing at least 51.1 grams of marijuana. Also found on his person was a small baggie containing methamphetamine residue.
